This course will introduce you to the liability environment for appraisers in both the broadest sense - complaints by your clients and by intended or unintended users and readers of your reports - and in the narrower sense - state and/or federal disciplinary actions. What is the difference between intentional and unintentional actions on your part? What constitutes discrimination? Is there a clear line that identifies what is discriminatory language?  Does your liability change for different categories of appraisals - eg. FNMA form reports vs Litigation Assignments vs Tax Assignments such as Estate or Trust work vs Hybrid or Desktop Appraisals? If you are cited, what are the limits of your liability and how can you protect yourself? Most importantly, what should you have in your work file and how long must you keep it? Remember most complaints against appraisers come long after the assignment was completed.

Instructor

Craig Capilla, Esq. will be teaching our class via ZOOM from his State of residence, Illinois. His legal practice includes civil litigation with an emphasis over the years on Professional Liability resulting in him defending clients (including Appraisers, Brokers, AMC's etc) in numerous states - to name a few: Illinois, Wisconsin, Minnesota, Maryland, Idaho, Michigan, Colorado, Indiana, Kentucky, Kansas, Tennessee, Delaware, and California. He has also defended clients in the Federal Court of Appeals, 7th Circuit. With such an extensive background, he brings considerable knowledge and insight to this timely topic. With changes in the appraisal industry that go well beyond the forms appraisers use, this is an important opportunity to learn more about the impact these changes may well have on how you practice and what you need to do to stay abreast of those changes and how they could affect you.
